 (12-31-08) New Requirements for Licenses and Permits: The State Board of Embalmers and Funeral Directors has posted the following notice. You now need what is called a "Tax Clearance Letter" to get an establishment license. We have also heard that some communities are now also requiring a "tax clearance" letter before issuing city licenses or permits, although do not be surprised if your local officials do not know exactly what it is they are now required to have in their file
     The Tax Clearance letter is not hard to get and you should get same-day service from the Department of Revenue. Simply follow the instructions on the web page and your Tax Clearance letter will be faxed to you. If you are having trouble getting your tax letter and are in an emergency situation where you need it right away, MFDEA can help members get their tax clearance letter by physically walking through the paperwork over at the Department. IMPORTANT NOTICE: Effective January 1, 2009, all applications for an establishment license must include a "no tax due" letter from the Department of Revenue, pursuant to section 114.083.4, RSMO which states:
    
"In addition of the provisions of subsection 2 of this section, beginning January 1, 2009, the possession of a statement from the department of revenue stating no tax is due under sections 143.191 to 143.265, RSMo, or sections 144.010 to 144.510 shall also be a prerequisite to the issuance or renewal of any city or county occupation license or any state license required for conducting any business where goods are sold at retail. The statement of no tax due shall be dated no longer than ninety days before the submission for application or renewal of the license."

(12-29-08) Sales Tax Questions with NPS Contracts: As we approach the end of the year, the MFDEA office has had several questions about Missouri Sales Tax as it relates to their NPS contracts and funerals.
    
The first (and easiest) issue is that sales tax is not due on any NPS funeral UNTIL YOU RECEIVE FUNDS FROM THE RECEIVERSHIP.
     In other words, since you have not yet been paid on the contract, no "sale" has yet taken place for sales tax purposes so there is not sales tax yet due on the funeral. Therefore,  on any NPS funeral that you have done for which you have not yet received money from the Receivership, no sales tax is yet due to be remitted.
    
Once you do receive funds from the Receivership, then sales tax on the transaction is due. The more complicated question is determining the correct amount of sales tax that applies to a transaction where you are receiving less than what you should have under the original contract with NPS. Look for a full explanation of how to properly calculate sales tax in this situation in the upcoming Missouri Director magazine.

(12-11-08) The next legislative hearing on Missouri's preneed law will be held on December 18th at 10:00 a.m. in Washington, Missouri at the City Hall Building, 405 Jefferson Street, Washington, Missouri.  This hearing will be before the House and Senate Committees charged with revising Missouri's pre need law (Chapter 436).  Anyone who wishes to testify is free to do so and we encourage as many funeral directors as possible to attend. (12-5-08) Senate Bill 1 is introduced: The first version of the new preneed law has been filed and can be found here:     http://www.senate.mo.gov/09info/pdf-bill/intro/SB1.pdf    
    
Once again, we have been told that this is a "placeholder" bill which everyone expects to be changed significantly, but it does include many of the recommendations from the Working Group that met this past summer. It is currently a 100% trusting bill. A full report on the bill will be provided next week after there has been time for careful review of all of the provisions. At first glance, there are a number of very good things in this bill, some provisions that will cause some problems and a few that need to be explained or clarified. (12-2-08) NPS BACKLOG: At the State Board meeting in Kansas City yesterday, it was announced that the NPS Receivership has processed all of the backlogged Missouri claims and that the checks should be in the mail in the next few weeks.  Of course, as we are in the holiday season, it may take until the end of the month before people receive their checks. More information will be provided as soon as it is available. 

FUNERAL DIRECTOR AND EMBALMERS SUSPENSION: The State Board announced that approximately 15 funeral directors and 16 embalmers in the State of Missouri are at risk of having their licenses suspended due to failure to pay Missouri Income Taxes.  If you or an employee are facing this situation the State Board needs to be provided with a “tax clearance” letter from the Department of Revenue ASAP.  It may not be necessary to have completely paid back taxes to get this letter as an installment payment agreement or even an ongoing negotiation of taxes owed may allow revenue to issue the letter.  However, if the State Board does not receive such documentation they have no discretion and must suspend the license.  If you need further information or assistance in this matter please contact Don Otto at (573) 635-1661.

LEGISLATIVE HEARINGS AND SENATE BILL 1: Senator Delbert Scott on Monday filed Senate Bill 1 which is a “rough draft” of a bill amending Missouri‘s Pre Need Law.  As noted previously this is a “place holder” bill that we know will be significantly changed before any vote is taken.  We will provide a link to the text of Senate Bill 1 as soon as it is available.  A number of funeral directors and consumers testified at the Pre Need legislative hearing yesterday in Kansas City.  The next Legislative Hearing is tentatively scheduled for December 18th in the St. Louis area although this could still change.  As soon as we have the exact time and place we will pass that information along. //Don Otto, Jr.

(11-24-08; 1:30 p.m.) Checks Have Arrived! Last week I noted that the NPS Receivership said another batch of checks was being sent out that day. I have received word from a number of funeral homes this morning that the received checks today so the process is moving.

Issue about "Orphaned" Contracts:
Several funeral homes have asked about the process I described on the contracts for which, initially, NPS cannot identify an insurance policy. The concern is that there is not timetable for NPS to review or get back to such claims and no idea how long it will take before the funeral homes are aware there might be a problem. This issue was addressed at the meeting last week, Mr. Cowherd of the CFA group made the point very strongly that the Receivership needs to get these "orphaned" contract cases to the Guarantee Fund as soon as possible so that the funeral homes can provide documentation to show "inditia of insurance." The "pilot program" that may allow funeral homes to get a preliminary indication of what contract they have might be at risk would help this matter somewhat but funeral homes still need to know what the status of their claims might be or, indeed, if the claim has even been received.
One suggestion was that, after the backlog of claims has been paid, to send out a notice to funeral homes stating that: "if you have submitted a claim to NPS anytime in 2008 but have not been paid or denied by _______, 2009 you should contact _________ at __________." This would at least give funeral homes the opportunity to be certain that their claims were in the system and, if not yet paid or denied, what the status might be.

Bill to Be introduced: A preneed bill will be submitted on December 1, 2009 in the Missouri Senate (the first day bills can be filed). Senator Scott wants to to this so that the preneed bill has "first place" in line of all the bills that will be filed this year. The bill that will be filed, however, will not be the bill that will be eventually voted on. This will be a very bare-bones, "placeholder" bill that will be substituted for once the joint legislative committee finishes its work. In other words, do not panic or get overly concerned about language that is or is not in the initial bill -- everyone knows it will be changed before the votes.

     The Legislative Hearing will also be at the Intercontinental Hotel starting at 2pm. The Legislative hearing is not part of the State Board meeting and will be in a different room at the hotel than where the State Board will be meeting.

(11-13-08) More NPS and Preneed Meeting News: As previously reported, the Legislative Committee on Preneed will be having a hearing in Kansas City at the Intercontinental Hotel at 2pm to hear testimony regarding NPS and Missouri's preneed laws. Anyone can testify at this meeting and we would like to have a good turnout of funeral directors even if they do not testify to meet the committee     Prior to that the State Board of Embalmers and Funeral Directors will be having their regular December open meeting. At 1:00pm on December 2nd the Special Deputy Receiver Donna Garrett and (I believe) Chuck Renn of the Missouri Guarantee Association will be on a conference call that will be open to anyone who wishes to call in and join the conference call. This is your chance to hear directly from the persons handling the NPS Claims process and hopefully to get your questions answered. The call-in number and procedures will be announced very soon but make your plans now to either be present in Kansas City or to phone-in. We will send out an update with the phone number as soon as it is posted by the State Board and will also put it on our web page at www.mofuneral.org.

(11-11-08) Pre-Need Hearing Date Set -- December 2: The next hearing in front of the Legislative Committee that is examining Missouri's preneed laws has been set for December 2 in Kansas City.
     The hearing will be at 2:00 p.m. the Intercontinental Hotel, 401 Ward Parkway. Public testimony will be accepted. Therefore, if anyone wishes to testify, they have that opportunity. If you would like, feel free to contact Don Otto about how the hearings are run, how the testimony is given, what the committee has already heard and what additional information they might be interested in. Although there will likely be a time limit on testimony, it is not a difficult process and this is a chance to be heard by the legislators.
     It is very helpful to have a good showing of funeral directors at these hearings EVEN IF YOU DO NOT TESTIFY. It is a chance to hear the most recent updates on the NPS situation and to see and meet the committee members that will be making these important decisions.

 (11-5-08) MORE ON NPS: This week, many funeral homes received a sort-of combination memo/update/press release/instructions from the NPS Receiver. Because of its length and some of the wording, our office has had calls concerned that something may have changed. This is not the case. Nothing has changed with what the Receivership/Guarantee Fund will be paying.
     The language that concerns some people is where it says the "Guarantee Fund does not pay on funeral contracts only on insurance policies." However, in Missouri almost all NPS money was either used to purchase insurance policies or it was supposed to have been used to purchase insurance policies (such as with many of the rollovers that were done in the last year). The Guarantee Fund will be covering all of those claims based on the insurance that was purchased or that was supposed to have been purchased. This is why the Guarantee Fund will be paying the face value on the vast majority of claims but not any growth or at-need prices.
     This is how it has always been from the moment the Guarantee Funds agreed to take on the NPS situation. There has been no change.
     Likewise the claim procedure set out in the memo is what we have been putting out to the members for the last couple of weeks. It is not worded as clearly as it is in other memos and emails on the subject, but it is still the same. MFDEA does have a concern about the delay the two-step process will cause in making future claims and we have a meeting scheduled later this month with the interested parties to discuss that and other matters.
     As noted earlier, I would like to hear from someone that has recently followed the new process for claims and let me know how it went so I can pass that information on.
     Lastly, at least one funeral home was given incorrect information by the Receivership that indicated it needed to send in itemized statements/bills for their already filed pre-Oct. 23) claims. This was incorrect. For claims that were filed under the old procedure prior to Oct 23 all you need to send to the Receivership is the Release/Assignment form and a W-9 form. It is only on FUTURE claims that NPS is requiring the itemized statement. The Receivership has corrected this error with the one funeral home but if you are told something like this about any of your claims, please call me at 573-635-1661 so we can clear things up.

(11-4-08) - NPS Checks Being Received!   The Association has heard from several Funeral Homes that they have received checks from the NPS Receivership on “old” claims filed before Oct 22. At the status review conference last week, we were told that the Receivership would try to process these on a first in/first out basis but that their could be some discrepancies as they were trying to do them in groups to speed up the process. Their goal was to catch up to the backlog of claims by the end of November. Therefore, if you have old claims and do not receive anything by then, you should fax an inquiry into the receivership with a list of your pending claims.
   MFDEA will be meeting with the Guarantee Fund, the State Board, the AG's office and others later this month to discuss the ongoing claims process. Our chief concern is the delay in payment that the various requirements are likely to cause. If you send in any new claims this month, please let our office know how the procedure worked for you and how you feel it could be improved.
FBI NPS Questionnaire:
Several Funeral Homes have received a questionnaire from the FBI regarding NPS operations. Our office has confirmed that this is a legitimate inquiry from the FBI and we expect that more funeral homes will receive the inquiry. If you receive one of these questionnaires we urge you to fill it out promptly and completely and return it as requested.

     Regarding the release: I have been told by the Guarantee Fund that  EITHER the family can sign the release or the Funeral Home will be able to sign a release that includes an indemnification clause. It is not REQUIRED that the family sign the release form. (although, when possible, it is my opinion that the legally better option for the funeral home is to have the family sign. That, of course, may not be the best option for your funeral home depending on the circumstances and the families you are dealing with)
     The reason for the release to be signed by either the funeral home or the family is because, in Missouri, the Guarantee fund pays money to "insureds." When they do this they need a release from the "insureds" that gives the Fund the right to try and recover the money they paid on the claim.
     Unfortunately in the current situation, NPS was, technically, the "insured" under most of the policies we are dealing with. For this and other reasons, as part of the Receivership, the "insured" is now considered to be those who are to receive the funeral goods or services. So even though the funeral home is getting the money, there still needs to be something sent to the Guarantee Fund that effectuates a "release" from the "insured."
     This, then, can be done one of two ways. Either the  next-of-kin signs the release form or the funeral home signs a release form (similar to the one that you signed for pre Oct-22 claims) that includes a paragraph where you indemnify the Guarantee Fund IF an insured should ever sue the Guarantee Fund. It is hard to imagine why or on what grounds family that has received the funeral they contracted for would ever sue, but this is what the Fund needs.
     Regarding the bill that they are requesting. This should be a bill that reflects your current prices for the goods and services that were provided and shows NPS as the party that should be paying the bill. This is being required to confirm that the contract amount is not MORE that what your current prices are (for example the contract was for $5000 but the funeral only cost $4500). I cannot imagine that actually happening, but the Receivership needs to have documentation to that effect.
     One major question is why the two-step process? Why can't you have all the forms there to be signed just one time? The answer to that is the Receivership wants to first send to the funeral home a document that shows what will ACTUALLY be paid on the contract and that the release form will show that that is the amount that was received by the funeral home on that specific contract. In other words, each release form will have specific numbers for that particular contract. Although this certainly adds time to the process, it will give the funeral home a very good and clear record of what NPS should have paid you and what you are getting from the Guarantee Fund.
      I have expressed the concern about the two-step process to the Guarantee Fund and they are looking at ways to try to address this issue.to speed things up. The Guarantee Fund is constrained by a number of state laws that requires it to do certain things, but their staff is very aware of the problem of delays in payment and I feel is trying to do everything in their power to speed up the process.  For those that have fax and internet capability, the process should go faster as you can fax the documents to Texas and you should receive the documents that need to be signed electronically.
     On a separate note, I have been informed that, if you signed and mailed in the FIRST version of the pre-Oct 22 Release form, you DO NOT need to sign and send in the revised version. It is the revised version that the Guarantee Fund is considering the official form regardless of which one you signed and sent in.

(10-31-08) NPS CLAIMS PROCEDURES FOR NEW CLAIMS
     As noted in earlier updates, all that a funeral home should need to do for claims filed prior to Oct 22 is to sign the Release form and send it and a W-9 form to the NPS receivership at the address listed below. The instructions and the updated release form can be found in our earlier emails and at the Lincoln Memorial Web Site:

1) Fill out a verified statement of performance (copies can be found on the Lincoln Web site and in the just mailed "Missouri Funeral Directors" magazine.)
2) Have an itemized statement of goods and services/funeral home bill; and
3)
a copy of the death certificate. (IF you are going to fax the documents, you will need to make a photocopy of the death certificate and write or stamp "copy" across the face of the document before faxing being careful not to obscure important information.)
4) a W-9 form only if you have not already sent a W-9 form to NPS -- YOU ONLY NEED TO SEND IN A W-9 FORM ONCE!!!
     You may then fax all of these documents to the NPS receivership at 512-328-0072 or you can mail the documents to:
Claims Department , PO BOX 160050, Austin, TX 78716.
     If you do choose to mail in the documents, be certain to keep a copy of everything for your records. After NPS receives this information, they will send to the funeral home a statement of what you will be paid along with a release for the next-of-kin to sign. The next of kin will need to sign this release which then must be sent back to NPS before your check will be mailed. (If for any reason the next-of-kin cannot sign the release, then the funeral home will have to sign a release with an indemnification clause similar to the one that was on the pre-Oct 22 claim release forms.)
As part of this process be sure to keep copies of all your documents and also be sure to keep track of the difference between what you receive from the Receivership and what NPS should have paid you. In the event that additional assets are recovered as part of the litigation, you will need to know what is the "shortage" on each contract. At the most recent Status Conference the NPS Receivership stated that one of their next priorities will be asset recovery. There is no way to know at this point how much, if anything, may be recovered, but it is important that funeral homes keep good records showing their losses

(10-29-08) The Missouri Guarantee Fund has listened to our concerns and has agreed to revise the release form that needs to be signed by funeral homes in order to get payment. LINKED HERE is a copy of the form. This takes care of the problems that I identified in the first release form. You only need to sign this form once (and send in a W-9) and that covers all claims submitted prior to Oct 22. As mentioned yesterday, as soon as NPS has these forms they will start processing the checks and hopefully will have the old claims cleared out in a month.

In the "What has your Association done for you lately" category, please let people, especially non-member firms, know that in the last week MFDEA has significantly helped its membership by working with the NPS parties on allowing copies of death certificates to be faxed and in getting a much better release form available.

(10-27-08; 3:45 p.m.) NPS and DEATH CERTIFICATES and OTHER
Working with the State Board, Vital Records and The Guarantee Fund we have reached a solution to the issue of how to submit Death Certificates on NPS Claims. NPS and the Guarantee Fund will accept a faxed copy of the official Death Certificate. Vital Records has informed us that, under the circumstances and in light of the court orders in Texas it is permissible to fax the Death Certificate to NPS so long as it is marked with the word "COPY." Of course the word "COPY cannot be obscuring any important information and if the faxed copy comes through unclear or not readable you may be asked to provide and actual Death Certificate.
There was not much new information at the Court hearing/status review today that was not covered in the earlier In The Loop report. We were told the status of the companies in liquidation and you can read the reports at:

One continuing question is when will funeral homes find out if any of their contracts are in what they are calling the "orphan" file, meaning there is no indication of insurance and that they are not, therefore, covered by the Guarantee Fund. The answer is they are working on it but there is no time frame yet on when that information will be sent to the funeral homes. When that happens we will have to address that issue further. I am hoping to have a response from the Guarantee Fund on my revisions to the General Release Form in the next day or so, so watch your emails for updates.

(10-27-08; 12:15 p.m.) NPS PAYMENT ALERT
According to the Guarantee Fund, the first batch of checks to Missouri Funeral Homes that have signed the General Release Form are being mailed this week. Checks should then be going out weekly. It is hoped that the entire backlog of claims will be caught up by the end of November. You can see the full press release below.
As of this moment the General Release Form has not been amended although we are still in discussions about the language. The problem with the current release is the undefined "Insureds" language and the "warrant" sentence in the third section. This language creates a liability danger, albeit hopefully a slim one, for the funeral home.
Unfortunately no checks will be sent to any funeral home that has not signed the release. Again, if it is possible for you to wait this week before signing to see if we can get a better release form, that is what we suggest. Otherwise, the attachment shows what the process will be. The status review conference is still scheduled for today and there may be more updates after that is completed.

(10-27-08) An Update for Missouri Pre-need Providers regarding NPS claims
On behalf of The Missouri Life and Health Insurance Guaranty Association (the "Association"), I am pleased to announce that payments on claims made for the fulfillment of Missouri preneed funeral contracts have begun. It is expected that the first payments will be mailed the week of October 27, 2008. The Association is working with the Special Deputy Receiver (the "SDR") to address the inventory of preneed claims that have been received, but not paid. These claims are being processed as rapidly as possible.
While it is not possible to make an unequivocal statement regarding the timeliness of claim payments, it is our hope to have significantly reduced the inventory of Missouri claims by the end of November, 2008.
Once all outstanding claims are paid up, we expect the processing of new claims to take approximately 45 days from the date that the documentation is submitted.
To ensure that all claims are properly paid, the following process will occur for all claim submissions:
1) Claims are submitted to the SDR, verified as complete and processed by the claims staff in compliance with the Liquidation Plan.
2) The processed claims are audited by consultants retained by the Association to assure compliance with state laws.
3)The Association notifies the SDR that the claim is approved.
4)If the appropriate completed Assignment Agreement and W9 have been submitted, then the claim will be ready for funding. 5) The Association funds payment of the claims and the SDR issues and mails a check.
We acknowledge that the delay in payments may have caused some financial constraints for Missouri preneed providers. We thank you for your patience during this action. Be assured that the SDR and the Association are working hard to ensure that claims are processed as quickly as possible and we thank you for your cooperation with this process. HOWEVER, DELAYS SHOULD BE EXPECTED DURING THE INITIAL IMPLEMENTATION OF THE LIQUIDATION PLAN. (10-24-08) NPS Confusion: Judging from the phone calls coming into the MFDEA office, there is a great deal of confusion regarding a number of NPS issues such as: should funeral homes sign the general release? When will the checks be sent? What forms will I need to send out on future claims? And so on. Unfortunately, it appears that different people may have been told different things at different times by different persons; MEDEA has requested clarification on a number of these items and, as noted yesterday, has submitted some proposed changes to the general release form. There will be a status review court hearing/phone conference on Monday that MFDEA will be monitoring. As of today we urge everyone not to panic or to spread unconfirmed information and wait for what we hear at the status review and from the parties on Monday. Also, repeating yesterday's advice, we urge everyone to hold off on signing the general release form that has been sent out if at all possible until we find out if any changes might be made to the document.
As part of the process, your funeral home will have to send in a W-9 form (taxpayer ID) to NPS along with the general release form before checks will begin to be processed. Here is the IRS link for a W-9 request form:

We also hope to have clarification on what will need to be sent to NPS for future claims, including what is being required regarding death certificates by Monday as well so be sure to look for the IN THE LOOP update late Monday or early Tuesday on these issues. NO LEGISLATIVE HEARING ON MONDAY.
As reported earlier, the Joint Legislative Committee was hoping to have a hearing on Monday to take further testimony on the preneed issue and on changes to Chapter 436. However, no such meeting is currently scheduled and I doubt there will be one until after the election. We will send out an email as soon as we know the time and place of the next hearing.
"Coroner's Bill" Changes Death Certificates (sometimes): SB 1139 passed and signed this last session, among other items, included changes to where a death and how a certificate should be filed in a number of situations particularly when the body has been transferred from one jurisdiction to another. Most of the coroner language is near the front of the bill. MFDEA will be meeting with the vital records department and with the Coroner's Association in early November to work on material that will clarify what this new law does and doesn't do and how it effects everyone. (10/21/08) The NPS/Lincoln Memorial Web-Site is back up (www.lincolnmemoriallife.com) after being down for a day and has NEW forms and instructions for processing claims. Hard copies of the forms and instructions will be in the next Missouri Funeral Director's magazine, but they can also be accessed here: http://www.lincolnmemoriallife.com/Forms.aspx.
Don Otto notes that it is illegal in Missouri for anyone other than authorized State officials to make reproductions of Death Certificates (in other words, you can't legally photocopy or fax a Missouri death certificate).This has caused some confusion since the NPS instructions call for a "copy of the certified death certificate." MFDEA has raised this issue and we know the State Board is also working to address this matter. Also note there are new phone and fax numbers for NPS in Austin, TX. The old NPS fax number 314-726-5760 is no longer operational due to the closure of the St. Louis office. At this time all faxes should be directed to the offices of Lincoln Memorial and Memorial Service in Austin at 512-328-0072.
The direct phone line to the Austin office is: 512-328-0075. The CORRECT toll-free number to NPS is 1-800-334-3851. The old 800 number (800-753-7619) still appears on forms on the web-site, but it appears to have been disconnected. As noted previously, the Judge's order approving the liquidation plan is "final" this week. The Court has scheduled a status review telephone conference on Monday the 27th. MFDEA will be present in the phone conference and we will report on anything significant that afternoon. As of today, we know of no problems with the Court in Texas that would delay the implementation of the liquidation plan.

10/8/08 NPS Liquidation Update NPS's operations in Clayton, Missouri have all but been shut down with all of the records and claims processing personnel now located in Austin, Texas. The Judge's Order approving the Liquidation Plan should become final on October 23. Based on conversations with the Receivership and state regulators MFDEA is cautiously optimistic NPS and the State Guarantee Funds will start processing claims very shortly after that date. The "800" NPS phone number is now answered in Austin and claims will be processed there.
Yesterday the Receivership formally requested that the Court approve that all communication, notifications and claims processing to be handled electronically (ie via email). While this would save the Receivership a great deal of money and would speed up claims, there are a number of funeral homes in Missouri that do not have computers or internet access. MFDEA has passed this concern onto the Receivership stating that some accommodation needs to be made for those funeral homes that do not have electronic communication capability.

PRENEED LEGISLATIVE COMMITTEE MEETS The Joint Senate-House Legislative Committee looking at revising Missouri's preneed laws met and took public testimony yesterday in Springfield Missouri. MFDEA as well as several funeral home owners and members of the public testified. It was a very informative meeting and it was very important that the committee members saw a good turn-out of funeral directors. The next hearing has been tentatively scheduled for the St. Louis area on October 27. Exact time and place information will be out shortly, but mark your calendars now if you are interested in attending. Most importantly, remember to attend the MFDEA legislative day at the Capitol in Jefferson City on Feb 4, 2009.
